Foreclosure Defense
With the recent passage of Utah Code. Sec 57-1-23.5, UCA, Utah’s homeowners are afforded more protection than ever against unauthorized foreclosure. Walter is actively litigating this new legislation in dozens of cases. Should the foreclosing trustee be unable to deliver written communications to the Lender, then foreclosure is deemed unauthorized and the homeowner is entitled to actual damages, attorney’s fees and court costs.
Condemnation / Eminent Domain
