Foreclosure Defense
With the recent passage of Utah Code. Sec 57-1-23.5, UCA, Utah's homeowners are afforded more protection than ever against unauthorized foreclosure. Walter is actively litigating this new legislation in dozens of cases. Should the foreclosing trustee be unable to deliver written communications to the Lender, then foreclosure is deemed unauthorized and the homeowner is entitled to actual damages, attorney’s fees and court costs.
Condemnation / Eminent Domain
Have you been notified by a local government, a utility company or UDOT that your property is being
taken for a utility easement, road project or other purpose. Walter has obtained compensation in an amount
over five times greater than the original offer in his case! Walter acted as an arbitrator on behalf of the
Property Rights Ombudsman's Office, where he made a determination of damages and issued an award.
Real Estate Taxes for Walgreens in Utah
Walgreens recently hired Walter to handle all real estate tax valuation appeals for its massive
$95 million portfolio of properties throughout Utah.
Defending Against Deficiency Judgments
Walter has successfully defended both commercial and residential real estate investors against bank
lawsuits seeking “deficiency judgments” – i.e., money judgments against individuals to cover the
outstanding loan amount owed after the foreclosure sale. The law requires that courts consider the fair
market value of the property when determining the amount of the deficiency judgment - the higher the determination of value the lower the deficiency judgment.

Walter has been successful in a variety of fraud cases, prosecuting civil actions against dishonest,
manipulative, individuals and/or entities in addition to defrauding parties in real estate investment schemes.

Appraisal Licensee representation before licensing review boards
